From CT: The FBI has begun investigating whether Hillary Clinton may have violated a federal law against making false statements about the handling of classified material on her personal email server while she was secretary of state.
Fox News reported that the new development represented an expansion of the current FBI investigation into the presumed 2016 Democrat nominee.
Undisclosed “intelligence sources” said to be familiar with the investigation told Fox that FBI agents are “under a lot of pressure” to get to the bottom of the matter.
“The agents involved are under a lot of pressure and are busting a**,” one source told Fox.
The new investigation centers around whether Clinton violated U.S. Code 18, Section 1001. That rule prohibits giving “materially false” statements regarding any matter under the jurisdiction of the federal government, as well as pressuring others to do so.
A felony violation of Section 1001 could result in a prison sentence of up to five years.
The FBI had already been investigating whether Clinton was guilty of “gross negligence” in the handling of classified information under the Espionage Act.
Statements not made under oath could still be considered a violation of the law, Fox reported.
If Clinton or any member of her team made false statements in an attempt to mislead federal investigators about the contents or disposition of her email, Section 1001 may apply.
“It is a cover-all,” former FBI intelligence officer Timothy Gill told Fox. “The problem for a defendant is when their statements cause the bureau to expend more time, energy, resources to de-conflict their statements with the evidence.”
Numerous sources have suggested that her email scandal, and the constant “drip” of emails continually being released to the public, will hamper her run for the Oval Office next year.
That could turn out to be the understatement of the year. If these reports are accurate, Hillary Clinton may soon find herself being measured for an orange pantsuit.
