Amber Heard’s Attorneys File Motion To Toss Verdict In Johnny Depp Trial

Amber Heard’s attorneys have filed a motion requesting that the court toss the verdict in her defamation trial against ex-husband Johnny Depp.

Following the conclusion of the defamation trial, in which the jury found Amber Heard had defamed Johnny Depp on all three counts raised in Depp’s case, the Aquaman actress is continuing in her attempts to have the decision overturned.

The latest motion filed by Amber Heard’s attorneys alleges a lack of evidence and “improper juror service” as reasons for either tossing the verdict, dismissing the complaint or ordering a new trial.

Amber Heard’s attorneys submitted a memorandum to Fairfax County Circuit Court, where the trial between Heard and Johnny Depp was held, detailing their argument.

The wide-ranging document claims that the damages awarded are unsupported by law, the verdicts reached on Johnny Depp’s and Amber Heard’s claims are inconsistent, Depp did not present sufficient evidence of actual malice or defamation by innuendo, and that the court should investigate Juror No. 15.

The document argues that Johnny Depp’s case abandoned “any claims that Ms. Heard’s statements were actually false” and “proceeded solely on a defamation by implication theory.” The memorandum also invokes the First Amendment in an attempt to dismiss damages awarded for “defamation by implication.”

The calls for an investigation of Juror No. 15 stem from the juror’s birth year being listed as 1945. However, Amber Heard’s attorneys have said that “publicly available information” indicates the juror was born in 1970, stating that Juror No. 15 was “clearly born later than 1945.”

“This discrepancy raises the question whether Juror 15 actually received a summons for jury duty and was properly vetted by the court to serve on the jury,” the case made by Amber Heard’s attorneys states.

The trial began in April, with a verdict finally being reached last month. Johnny Depp was awarded over $10 million in damages, while Amber Heard was awarded $2 million in compensatory damages when only one point raised in her countersuit was found to be defamatory.
