A Delaware cop has admitted to receiving oral sex from a woman wanted on assault costs — however claims the encounter in his police cruiser was consensual, in accordance with his lawyer.

The lawyer for Thomas Oliver Jr., 36, stated the Wilmington police corporal made an “egregious and silly” mistake by having a consensual tryst with a woman he believed to be a prostitute whereas on responsibility and in uniform in his marked police automobile in October 2018, the Delaware Information Journal reported.

The suspended cop is charged with second-degree rape, sexual extortion, having sex with an individual in police custody and official misconduct.

“Thomas Oliver doesn’t deny it was fallacious on one degree, not a legal degree, for him to pursue his personal private pleasures whereas serving as a Wilmington police officer,” lawyer Eugene Maurer instructed jurors Tuesday in his opening assertion.

He stated proof will show that Oliver, an 11-year division veteran, had “consensual sexual activity” with the woman whom he “believed to have an interest in him” previous to the encounter.

“He’ll deny that he compelled sex on anybody,” Maurer instructed jurors.

Prosecutors, in the meantime, allege Oliver was patrolling by himself when he known as the woman — who was wanted on misdemeanor assault costs on the time — over to his patrol automobile. Oliver then “compelled” the woman into the passenger seat earlier than making her give him oral sex, Deputy Legal professional Basic Davis Skoranski stated.

“The one purpose she did it’s she thought she was below arrest and had no alternative,” Skoranski continued. “The allegation is that Mr. Oliver instilled a worry in [the woman] that he was going to have her arrested for that warrant.”

Oliver then threw $three on the woman after she completed the sex act, Skoranski stated, including {that a} swab take a look at later confirmed proof of semen in the sufferer’s mouth, in addition to Oliver’s DNA.

The unidentified mom instructed police after Oliver was arrested in February that she feared she could be arrested if she didn’t carry out oral sex on the officer, the newspaper reviews.

Oliver is anticipated to testify on his behalf. He was suspended from the drive after the sufferer instructed police of the allegations, the Delaware Information Journal reported in February.
